29 CFR 1926.1053(b)(4): Ladder(s) were used for purposes other than the purpose for which they were designed: (a) On or about September 12, 2024, the employer did not ensure that the Werner five (5) foot self-supporting portable step ladder was properly used as designed when it was leaned against a 4.9 foot tall trench wall while in its closed position and used by employees to access and egress the trench. This exposed employees to a tip and fall hazard.

29 CFR 1926.1053(b)(1): Where (a) portable ladder(s) was/were used for access to an upper level landing surface and the ladder's length did not allow the ladder side rails to extend at least 3 feet (0.9 m) above the upper landing surface being accessed, the ladder was not secured at its top to a rigid support that will not deflect, and/or a grasping device was not provided to assist employees in mounting and dismounting the ladder. (a) On or about September 12, 2024, the employer did not remove the Werner five (5) foot self-supporting portable step ladder improperly used to access the 4.9 foot deep drainage tile trench when it did not extend at least 3 feet (0.9 m) above the upper landing surface being accessed, and the ladder was not secured at its top and/or a grasping device was not provided to assist employees in mounting and dismounting the ladder exposing employees to a trip and fall hazard.
