29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace: (a) On August 2, 2024, and at times prior, employees were grinding cement floors with a Husqvana PG Concrete Floor grinder, wearing 3M half face respirators fitted with pink organic filters without being provided a medical evaluation to ensure that they were medically fit to wear a respirator.
