29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems:  (a)Viergets General Building at 21765 Sidney Stage Road, Piedmont, SD 57769: On or about and at times prior to September 18, 2024, the exposing employer did not ensure that employees were protected from falls while conducting commercial framing activities on a commercial building. This condition exposed the employees to fall hazards greater than six feet.

29 CFR 1926.501(b)(2)(i): Each employee who was constructing a leading edge 6 feet (1.8 m) or more above lower levels was not protected from falling by guardrail systems, safety net systems, or personal fall arrest systems:   (a)Viergets General Building at 21765 Sidney Stage Road, Piedmont, SD 57769: On or about and at times prior to September 18, 2024, the exposing employer did not ensure that employees conducting leading edge work on the second-level roof were protected from falling by guardrail systems, safety net systems, or personal fall arrest systems.  This condition exposed employees to fall hazards greater than six feet.

29 CFR 1926.20(b)(2): The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has the authority to take prompt corrective measures to eliminate them:  (a)Viergets General Building at 21765 Sidney Stage Road, Piedmont, SD 57769: On or about and at times prior to September 18, 2024, the exposing employer did not ensure an accident prevention program was developed and implemented for the work environment to include regular inspections of the jobsite, materials, and equipment; conducted by a competent person. Employees were conducting framing operations on a commercial property without the use of a fall protection system and a lack of training documentation.  This condition exposed employees to various hazards while working on site.
