29 CFR 1910.178(l)(1)(i): The employer did not ensure that each Powered Industrial Truck (PIT) operator was competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l):  (a)Palace Builders, Inc. at 601 East 4th Avenue, Mitchell, SD 57301:  On or about and at times prior to September 17, 2024, the employer did not ensure that all powered industrial truck operators were competent to operate the JLG Telehandler, Model 8042, safely by a successful completion of a training program.  This condition exposed employees to struck-by hazards associated with improper forklift operations.

(a)Palace Builders, Inc. at 601 East 4th Avenue, Mitchell, SD 57301:  On or about and at times prior to September 17, 2024, the employer did not ensure employees were protected from fall hazards while installing corrugated steel roofing panels on the roof of a commercial steel structure.   This condition exposed employees to fall hazards greater than 15 feet.

29 CFR 1926.454(a): The employer did not have each employee who performed work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards:  (a)Palace Builders, Inc. at 601 East 4th Avenue, Mitchell, SD 57301:  On or about and at times prior to September 17, 2024, the employer did not ensure a training program was developed and implemented to ensure designated site personnel were trained in the safe use of Skyjack Mobile Scaffold, Model: 7127, platform system to include hazards related to but not limited to, stepping onto and off the mobile scaffold's top railing to access the roof.   This condition exposed employees to fall hazard injuries at heights of greater than 10 feet.  (b)Palace Builders, Inc. at 601 East 4th Avenue, Mitchell, SD 57301:  On or about and at times prior to September 17, 2024, the employer did not ensure a training program was developed and implemented to ensure designated site personnel were trained in the safe use of Skyjack Mobile Scaffold, Model: 7127 platform system prior to use.   This condition exposed employees to various hazards associated with the use of the scaffolding.
