29 CFR 1910.134(c)(1): In any workplace where respirators are necessary to protect the health of the employees or whenever respirators are required by the employer, the employer did not establish and implement a written respiratory protection program with required worksite-specific procedures: Dry-cleaning room area: Peanut Cleaners Inc. 46-11 54th Ave, Maspeth, NY. a) The employer provided and required an employee to wear a tight-fitting 3M half-mask elastomeric respirators with 3M 6001 vapor cartridges/filters, while conducting dry-cleaning operations utilizing 99.5 to 99.9 % Perchloroethylene. The employer did not implement a written respiratory protection program; on or about 09/18/2024. Note: The employer is required to submit abatement certification for this item in accordance with 29 CFR 1903.19.

The employer did not provide medical evaluations to the employee prior to required use of respirators; on or about 09/18/2024.
