29 CFR  1910.1200(e)(1):The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met: (Construction Reference: 1926.59)  At the job site located at 11656 West Scarlett Lane Maize, KS, employees engaged in roofing activities were exposed to chemical hazards in that a written hazard communication program had not been developed, implemented and maintained at the jobsite.  Employees were handling asphalt shingles, gasoline and sealant.  All of  these chemicals can cause eye and skin irritation.  Asphalt shingles and  gasoline may also cause drowsiness, dizziness and upper respiratory irritation. Additionally, gasoline, can act as a fueling agent due to its extreme flammability as a liquid and vapor.

29 CFR  1910.1200(g)(1): Employers did not have a safety data sheet in the workplace for each hazardous chemical which they use: (Construction Reference: 1926.59)  At the job site located at 11656 West Scarlett Lane Maize, KS, employees engaged in roofing activities were exposed to chemical hazards in that they were not provided access to the Safety Data Sheet (SDS) for asphalt shingles, the Tribuilt sealant and gasoline at the jobsite.    All of  these chemicals can cause eye and skin irritation.  Asphalt shingles and  gasoline may also cause drowsiness, dizziness and upper respiratory irritation. Additionally, gasoline, can act as a fueling agent due to its extreme flammability as a liquid and vapor.

29 CFR  1910.1200(h)(1):Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area: (Construction Reference: 1926.59)  At the job site located at 5609 Lakecrest Dr. Shawnee, KS 66218, employees engaged in residential roofing activities were exposed to chemical hazards in that they were not provided training on the chemical hazards of gasoline. The chemical hazards associated with gasoline include: skin and eye irritation, drowsiness and/or dizziness, throat, lung and respiratory tract irritation, silicosis/siderosis, vomiting and/or diarrhea, suspected of causing cancer and may be fatal if swallowed and enters airways. Additionally, gasoline can act as a fueling agent due to its extreme flammability as a liquid and vapor.
