29 CFR  1926.850(a):An engineering survey was not performed by a competent person to determine the conditions of the framing, floors and walls and the possibility of unplanned collapse of any portion of the structure prior to permitting employees to start demolition operations:  (a) 535 West Avalon Ave., Muscle Shoals: On or about 9/6/2024, the employer exposed employees to construction hazards such as but not limited to, struck by and fall hazards, in that an engineering survey was not completed to ensure the removal of load bearing structural member as well as non-structural walls, internal systems such as piping were conducted to prevent or minimize potential employee exposures.  In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

29 CFR 1904.39(a)(2): The employer did not report within 24-hours a work-related incident resulting in in-patient hospitalization, amputation or the loss of an eye.   (a) 535 West Avalon Ave., Muscle Shoals: On or about 09/06/2024, the employer did not report to OSHA a work-related inpatient hospitalization of an employee within 24 hours.  Britt Demolition & Recycling, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1904.39(a)(2), which was contained in OSHA inspection number 1638215, citation number 1, item number 1 and was affirmed as a final order on 6/23/23, with respect to a workplace located at 535 West Avalon Ave. Muscle Shoals, AL .

29 CFR  1926.503(b)(1): The employer did not verify compliance with paragraph (a) of this section by preparing a written (training) certification record including the name or other identity of the employee trained, the date(s) of the training, and the signature of the person who conducted the training or the signature of the employer.   (a)At 535 West Avalon Avenue, Muscle Shoals, Alabama on or about 9/6/2024, the employer did not verify compliance with 1926.503 Paragraph a, in that no certification record of training of employees to recognize fall and struck-by hazards was provided.  This exposed employees to fall and struck by hazards encountered at the worksite.  In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).
