29 CFR 1910.134(c)(1): A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use: (Construction Reference 1926.103)  a) On or about September 24, 2024, the employer did not ensure that a that a written respiratory protection program was established for employees required to wear respiratory protection, including 3M 6200 elastomeric half facepiece respirator and 3M 8511 N95 filtering facepiece respirator, when cutting and/or chipping concrete with hand powered tools.  In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

29 CFR 1910.134(k)(1): The employer did not provide respirator training that would ensure each employee could demonstrate knowledge of items in section (i)-(vii): (Construction Reference 1926.103)   a) On or about September 23, 2024, the employer did not ensure that employees demonstrated knowledge on why the respirator was necessary and how improper fit, usage, storage or maintenance can compromise the protective effect of the respirator. The employees were required to wear 3M 6200 elastomeric half facepiece respirator and 3M 8511 N95 filtering facepiece respirator, when working indoor cutting and/or chipping concrete.  In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

29 CFR 1926.1153(g)(1): The employer did not establish and implement a written exposure control plan:  a) On or about September 24, 2024, the employer did not establish and implement a site specific written exposure control plan that outlined at least the following elements: descriptions of the tasks that can expose employees to silica, descriptions of the work practices, respiratory protection, engineering controls, description of housekeeping measures, and if necessary, procedures to limit access to areas to reduce employee exposure to crystalline silica. Employees were working indoor cutting and/or chipping concrete containing up to 8% crystalline silica quartz.  In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).
