29 CFR 1910.28(b)(1)(i):(1) Unprotected sides and edges. (i) Except as provided elsewhere in this section, the employer must ensure that each employee on a walking-working surface with an unprotected side or edge that is 4 feet (1.2 m) or more above a lower level is protected from falling by one or more of the following: (A) Guardrail systems; (B) Safety net systems; or (C) Personal fall protection systems, such as personal fall arrest, travel restraint, or positioning systems. a) On or before October 1, 2024, the employer failed to ensure that employees performing emergency tree removal on a residential structure were utilizing a fall protection system. As a result, employees were exposed to fall heights of 13'-2" while working at the edge of a balcony with a missing railing.

29 CFR 1910.67(c)(2)(v):(v) Extensible and articulating boom platforms. A personal fall arrest or travel restraint system that meets the requirements in 29 CFR part 1910, subpart I, shall be worn and attached to the boom or basket when working from an aerial lift. a) On or about October 1, 2024, the employer failed to ensure that employees continuously used a travel restraint system while working in the bucket of an aerial lift. Specifically, an employee disconnected from the restraint system while suspended in the lift to exit onto a balcony.
