OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm, in that employees were exposed to Struck-by hazards: a) This violation occurred on or about October 1, 2024, and times prior thereto, at the Southwest Shipyards LP in Channelview, Texas, where crane operators were operating Comedil, Sun and Comansa Tower Cranes to lift ship parts and equipment without a visual weight limit indicator. b) This violation occurred on or about October 1, 2024, and times prior thereto, at the Southwest Shipyards LP in Channelview, Texas where crane operators were required to operate Comedil, Sun and Comansa Tower Cranes without having a load test conducted on the crane to verify that the crane can safely perform its functions following repair/modifications to the crane. c) On or about October 1, 2024, and times prior thereto, at the Southwest Shipyards LP in Channelview, Texas, where crane operators were operating Comedil, Sun and Comansa Tower Cranes to lift ship parts and equipment without a manufacturers maximum rated safe working load chart being posted near where the remote controls are being used.
