On or about October 2, 2024, and times prior thereto, the employee's used a pneumatic nail gun without eye protection while installing roofing shingles throughout the roof of a residential dwelling under construction.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system. On or about October 2, 2024 and at times prior thereto, employees conducted roofing activities at a height greater than six feet with inadequate fall protection system. Andres Briones was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 1713604, citation number 1, item number 1 and was affirmed as a final order on February 22, 2024, with respect to a workplace located at 102 Silas Street, Sinton, Texas 78387. Andres Briones was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 1727993, citation number 1, item number 2 and was affirmed as a final order on September 30, 2024, with respect to a workplace located at Neesa Drive, Corpus Christi, Texas 78387.
