29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): On or about October 2, 2024, it was observed that employees engaged in roofing activities for J & B Roofing LLC at a residential construction site located at 7972 North 155th Street, Bennington, Nebraska were exposed to fall hazards in that employees on an elevated working surface were not protected from falling. Instances included, but were not limited to: i. Unprotected employees working at the front of the home approximately 18 feet above the next lower level as measured from the ground to the eave, and ii. Unprotected employees working at the back of the home approximately 12 feet, 5 inches above the next lower level as measured from the ground to the eave.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards: On or about October 2, 2024, it was observed that employees engaged in roofing activities for J & B Roofing LLC at a residential construction site located at 7972 North 155th Street, Bennington, Nebraska were exposed to fall hazards in that employees on an elevated working surface approximately 18 feet above the next lower level as measured from the ground to the eave were not trained in the recognition of fall hazards of falling when installing ridge caps.
