OSH ACT of 1970 Section (5)(a)(1):Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by hazards:  a) 1150 Kingsley St, Asbury Park, NJ - The operator of the JLG Rough Terrain Forklift Truck, Model 1044C-54 Series II, allowed an employee to pass under the elevated portion of the truck carrying wooden truss bundles, which were held aloft with the forks of the rough terrain forklift truck (RTFT). The employee suffered severe head and spine injuries when the load became unstable and the bundle of wooden trusses struck the employee in the head. This condition was noted on or about October 2, 2024.  NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULTIN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
