On or about October 3, 2024, at the above addressed jobsite, employee using a pneumatic nail gun was not utilizing eye protection, thereby exposing the employee to hazards associated with eye injuries.

29 CFR 1926.1053(b)(1): Where (a) portable ladder(s) was/were used for access to an upper level landing surface and the ladder's length did not allow the ladder side rails to extend at least 3 feet (0.9 m) above the upper landing surface being accessed, the ladder was not secured at its top to a rigid support that will not deflect, and/or a grasping device was not provided to assist employees in mounting and dismounting the ladder.  a. On or about October 3, 2024, the portable ladder used to access the roof did not extend at least three (3') feet above the upper landing surface nor was it secured at the top, thereby exposing employees to the hazards associated with falls.

29 CFR 1926.503(b)(1): The employer did not verify compliance with paragraph (a) of this section by preparing a written (training) certification record including the name or other identity of the employee trained, the date(s) of the training, and the signature of the person who conducted the training or the signature of the employer.   a. On or about October 3, 2024, the employer failed to certify that employees had been trained to recognize and minimize fall hazards. Employees were exposed to fall hazards at 8 feet, 9 inches high while performing roofing activities on a residential structure without properly using fall protection.
