29 CFR 1910.95(c)(1): The employer shall administer a continuing, effective hearing conservation program, as described in paragraphs (c) through (o) of this section, whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level (TWA) of 85 decibels measured on the A scale (slow response) or, equivalently, a dose of fifty percent. For purposes of the hearing conservation program, employee noise exposures shall be computed in accordance with appendix A and Table G-16a, and without regard to any attenuation provided by the use of personal protective equipment.  On or about October 3, 2024, the employer did not implement an effective hearing conservation program for employees over the action level of 85 decibels on the A weighted scale, including operators working on the Model A Landmaco threading machines.  The hearing conservation program should include but is not limited to audiometric testing of employees, employee training on noise hazards, conducting noise sampling work area, and preventing employees from developing noise induced hearing loss.

29 CFR 1910.95(d)(1): When information indicates that any employee's exposure may equal or exceed an 8-hour time-weighted average of 85 decibels, the employer failed to develop and implement a monitoring program.  On or about October 3, 2024, the employer failed to implement a noise monitoring program for employees working on the Model A Landmaco Threading machines, subjecting them to the potential for noise induced hearing loss.

29 CFR 1910.95(g)(1): The employer shall establish and maintain an audiometric testing program as provided in this paragraph by making audiometric testing available to all employees whose exposures equal or exceed an 8-hour time-weighted average of 85 decibels.  On or about October 3, 2024, the employer failed to implement an audiometric testing program for employees exposed to occupational noise over the action level of 85 decibels on the A weighted scale, which can cause noise induced hearing loss. This includes but is not limited to employees working on the Model A Landmaco threading machines.

The employer shall institute a training program and ensure employee participation in the program.  On or about October 3, 2024, the employer failed to implement a training program for employees exposed to occupational noise hazards over the action level of 85 decibels on the A weighted scale, which can cause noise induced hearing loss. This includes but is not limited to operators on the Model A Landmaco threading machines.

29 CFR 1910.147(c)(1): Energy control program. The employer shall establish a program consisting of energy control procedures, employee training and periodic inspections to ensure that before any employee performs any servicing or maintenance on a machine or equipment where the unexpected energizing, startup or release of stored energy could occur and cause injury, the machine or equipment shall be isolated from the energy source and rendered inoperative.  On or about October 3, 2024, the employer failed to develop a hazard control program for the Model A and Model C Landmaco threading machines rotating up to 600 RPM, powered by electricity and air, when maintaining or adjusting the threaders for different sized pieces. Without the program, employees maintaining the machines are exposed to hazards that can cause severe injury to their fingers and hands including caught in, laceration, and entanglement hazards if the machine were to accidentally start up.

29 CFR 1910.212(a)(3)(ii): The point of operation of machines whose operation exposes an employee to injury, shall be guarded. The guarding device shall be in conformity with any appropriate standards therefor, or, in the absence of applicable specific standards, shall be so designed and constructed as to prevent the operator from having any part of his body in the danger zone during the operating cycle.  On or about October 3, 2024, the employer failed to ensure that the point of operation for employees placing, pushing, and removing products from the Model A and Model C Landmaco threading machines were adequately guarded. Without a guard or another protective measure limiting employee's hands and exposure to the 600 RPM rotating threaders it exposes threading machine operators to caught in, laceration, and entanglement hazards.

On or about October 3, 2024, the employer failed to create and implement a written Personal Protective Equipment (PPE) hazard assessment for employees operating the Model A and Model C Landmaco Threading Machines.
