29 CFR  1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure.  a) On or about October 3, 2024, at 2797 Shaffer Avenue, Cincinnati, Ohio, the employer failed to ensure that Employee #1, performing re-roofing activities on a residential home, was protected from fall hazards while working at a height of approximately 15 feet 3 inch above an asphalt driveway. The employer did not provide or enforce the use of guardrail systems, safety net systems, or personal fall arrest systems. As a result, Employee #1 was exposed to a fall hazard and fell to the asphalt driveway below, sustaining fatal injuries.  b) On or about October 3, 2024, 2797 Shaffer Avenue, Cincinnati, Ohio, the employer failed to ensure that employees,  performing re-roofing activities on a residential home, was protected from fall hazards while working at a height of approximately 13 feet above hard soil. The employer did not provide or enforce the use of guardrail systems, safety net systems, or personal fall arrest systems. As a result, employees were exposed to a fall hazard during the course of the work.

29 CFR  1926.502(d)(15): Anchorages used for attachment of personal fall arrest equipment shall be independent of any anchorage being used to support or suspend platforms and capable of supporting at least 5,000 pounds (22.2 kN) per employee attached, or shall be designed, installed, and used as follows:  (i) as part of a complete personal fall arrest system which maintains a safety factor of at least two; and  (ii) under the supervision of a qualified person.  a) On or about October 3, 2024, at 2797 Shaffer Avenue, Cincinnati, Ohio, the employer failed to ensure that the anchor points used for attaching personal fall arrest equipment were capable of supporting 5,000 pounds (22.2 kN) as required in that, anchor points were installed by nailing ropes directly into the roof decking. As a result, employees working on the roof, approximately 13 feet above an asphalt driveway and hard soil, were exposed to a fall hazard without adequate fall protection.

29 CFR  1926.503(a)(2): Training program. The employer shall assure that each employee has been trained, as necessary, by a competent person qualified in the following areas: (i) The nature of fall hazards in the work area; (ii) The correct procedures for erecting, maintaining, disassembling, and inspecting the fall protection systems to be used; (iii) The use and operation of guardrail systems, personal fall arrest systems, safety net systems, warning line systems, safety monitoring systems, controlled access zones, and other protection to be used; (vi) The correct procedures for the handling and storage of equipment and materials and the erection of overhead protection; and (vii) The role of employees in fall protection plans; (viii) The standards contained in this subpart.  a) On or about October 3, 2024, at 2797 Shaffer Avenue, Cincinnati, Ohio, the employer failed to ensure that Employee #1 received training in fall protection as required. Specifically, the employer did not train Employee #1 on the nature of fall hazards in the work area, the correct procedures for inspecting the fall protection system being used, the use and operation of personal fall arrest systems, and the applicable standards contained in Subpart M - Fall Protection. As a result, Employee #1 was exposed to a fall hazard while working on a roof approximately 15 feet above an asphalt driveway, ultimately leading to a fatal fall.  b) On or about October 3, 2024, at 2797 Shaffer Avenue, Cincinnati, Ohio, the employer failed to ensure that Employee #4 received training in fall protection as required. Specifically, the employer did not train Employee #4 on the nature of fall hazards in the work area, the correct procedures for inspecting the fall protection system being used, the use and operation of personal fall arrest systems, and the applicable standards contained in Subpart M - Fall Protection. As a result, Employee #4 was exposed to fall hazards while performing re-roofing activities without knowledge or preparation to mitigate those hazards.  c) On or about October 5, 2024, at 2797 Shaffer Avenue, Cincinnati, Ohio, the employer failed to ensure that Employee #5 received training in fall protection as required. Specifically, the employer did not provide training on the nature of fall hazards in the work area, such as working at a height of approximately 14 feet above a hard asphalt surface, or the correct procedures for inspecting the fall protection system being used. 29 CFR  1926.1053(b): Use. The following requirements apply to the use of all ladders, including job-made ladders, except as otherwise indicated:  (1) When portable ladders are used for access to an upper landing surface, the ladder side rails shall extend at least 3 feet (.9 m) above the upper landing surface to which the ladder is used to gain access; or, when such an extension is not possible because of the ladder's length, then the ladder shall be secured at its top to a rigid support that will not deflect, and a grasping device, such as a grabrail, shall be provided to assist employees in mounting and dismounting the ladder. In no case shall the extension be such that ladder deflection under a load would, by itself, cause the ladder to slip off its support.  a) On or about October 05, 2024, at 2797 Shaffer Avenue, Cincinnati, Ohio, the employer failed to ensure that the portable ladders being utilized by employees performing roofing activities to access the roof was extended 3 feet above the upper landing surface. As a result, employees performing roofing activities were exposed to fall hazards while accessing and descending the roof, which was approximately 13 feet above the ground.

29 CFR  1904.39(a)(1): Basic Requirement.  Within eight (8) hours after the death of any employee as a result of a work-related incident, you must report the fatality to the Occupational Safety and Health Administration (OSHA), U.S. Department of Labor.  a) On or about October 3, 2024, at 2797 Shaffer Avenue, Cincinnati, Ohio, the employer failed to report a work-related fatality resulting from a fall within the required eight-hour timeframe.
