29 CFR 1926.453(b)(2)(v): A safety harness was not worn and/or a lanyard was not attached to the boom or basket when working from an aerial lift:   (a)C. Eagle Construction, LLC at 147 Chisolm Drive, Box Elder, SD 57719:  On or about and at times prior to October 8, 2024, the employer did not ensure employees were protected from falls by a personal fall arrest system while conducting roofing activities and working from a JLG Aerial lift Platform, Model Number 660SJ US, Serial Number 0300268093.  This condition exposed employees to fall and ejection hazards while working from the aerial lift.

29 CFR  1926.501(b)(10): Each employee engaged in roofing activities on low-slope roofs with unprotected sides and edges 6 feet or more above lower levels, was not protected from falling by guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line system and guardrail system, warning line system and safety net system, or warning line system and personal fall arrest system, or warning line system and safety monitoring system:   (a)C. Eagle Construction, LLC at 147 Chisolm Drive, Box Elder, SD 57719:  On or about and at times prior to October 8, 2024, the employer did not ensure that employees were protected from falls while conducting roofing operations on a low slope commercial property. This condition exposed the employees to fall hazards greater than six feet.
