(i) Except as provided elsewhere in this section, the employer must ensure that each employee on a walking-working surface with an unprotected side or edge that is 4 feet (1.2 m) or more above a lower level is protected from falling by one or more of the following:  On or about October 9, 2024, employees working on the vertical band saws were exposed to fall hazards of approximately 8 feet when lifted on a pallet by the forklift to retrieve foam material.  Abatement certification is required for this item in accordance with 29 CFR 1903.19(c).

29 CFR  1910.147(c)(1): Energy control program. The employer shall establish a program consisting of energy control procedures, employee training and periodic inspections to ensure that before any employee performs any servicing or maintenance on a machine or equipment where the unexpected energizing, startup or release of stored energy could occur and cause injury, the machine or equipment shall be isolated from the energy source and rendered inoperative.  On or about October 9, 2024, employees who operate the band saws were not provided with a lockout/tagout program to prevent accidental startup of the bandsaws when changing the blade.  Abatement certification is required for this item in accordance with 29 CFR 1903.19(c).

29 CFR  1910.178(l)(2)(ii): Training shall consist of a combination of formal instruction (e.g., lecture, discussion, interactive computer learning, video tape, written material), practical training (demonstrations performed by the trainer and practical exercises performed by the trainee), and evaluation of the operator's performance in the workplace.  On or about October 9, 2024, employees who operate the forklift were not provided with the required training prior to operating the forklift. Employees operate the forklift daily for shipping/receiving operations and also for retrieving materials to cut.  Abatement certification is required for this item in accordance with 29 CFR 1903.19(c).

29 CFR  1910.212(a)(1): Types of guarding. One or more methods of machine guarding shall be provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks. Examples of guarding methods are-barrier guards, two-hand tripping devices, electronic safety devices, etc.  On or about October 9, 2024, employees operating the bandsaw while cutting foam and cardboard material were exposed to approximately 5 1/2 inches of unused blade, creating amputation hazards. The employer failed to provide employees with machine guarding to protect against the point of operation.  Abatement certification is required for this item in accordance with 29 CFR 1903.19(c).

29 CFR  1910.213(i)(1): All portions of the saw blade shall be enclosed or guarded, except for the working portion of the blade between the bottom of the guide rolls and the table. Bandsaw wheels shall be fully encased. The outside periphery of the enclosure shall be solid. The front and back of the band wheels shall be either enclosed by solid material or by wire mesh or perforated metal. Such mesh or perforated metal shall be not less than 0.037 inch (U.S. Gage No. 20), and the openings shall be not greater than three-eighths inch. Solid material used for this purpose shall be of an equivalent strength and firmness. The guard for the portion of the blade between the sliding guide and the upper-saw-wheel guard shall protect the saw blade at the front and outer side. This portion of the guard shall be self-adjusting to raise and lower with the guide. The upper-wheel guard shall be made to conform to the travel of the saw on the wheel.  On or about October 9, 2024, employees operating the bandsaw while cutting wood material were exposed to approximately 5 1/2 inches of unused blade, creating amputation hazards. The employer failed to provide employees with machine guarding to protect against the point of operation.  Abatement certification is required for this item in accordance with 29 CFR 1903.19(c).

29 CFR  1910.37(a)(3): Exit routes must be free and unobstructed. No materials or equipment may be placed, either permanently or temporarily, within the exit route. The exit access must not go through a room that can be locked, such as a bathroom, to reach an exit or exit discharge, nor may it lead into a dead-end corridor. Stairs or a ramp must be provided where the exit route is not substantially level.  On or about October 9, 2024, employees were not provided free and unobstructed exit routes in the storage area as they were obstructed by cardboard and foam material.
