OSH ACT of 1970 Section (5)(a)(1) The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees 29 CFR 1910.212(a)(1): One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks: On or about October 9, 2024, and times prior thereto, in the Gen Fab section, employees were operating CNC machines to drill such as but not limited to metal stock, without adequate protection, in that: a) On the right door of the HASS VF4, the safety glass was discolored and deteriorated. b) On the left door HASS VF4SS, the safety glass was damaged. c) On the right door HASS VF3, the safety glass was damaged and deteriorated. Among other methods, one feasible and acceptable means of abatement would be to: 1. Enforce the requirement to inspect the equipment for damage on a daily or shift basis; and, 2. Ensure that the deficiencies are repaired before returning the equipment back to service.

29 CFR 1910.147(c)(6)(i): The employer did not conduct a periodic inspection of the energy control procedure at least annually to ensure that the procedure and the requirement of this standard were being followed: On October 9, 2024, in the Gen Fab section, employees performed servicing and maintenance on various machinery and equipment such as but not limited to CNC machines. Lockout procedures had not been inspected annually.
