29 CFR 1926.102(a)(1): Eye and face protective equipment were not used when machines or operations presented potential eye or face injury from physical agents: a) On or about October 9, 2024, at a worksite located at 2610 41st Street NW, top floor, employees engaged in framing were not wearing eye protection provided while operating pneumatic tools such as nail guns, exposing them to a struck-by hazard. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the Certification of Corrective Action Worksheet), in addition, documentation demonstrating the abatement is complete must be included with your certification. This documentation may include but is not limited to evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

29 CFR 1926.501(b)(13):Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): a) On or about October 9, 2024, at a worksite located at 2610 41st Street NW, top floor, employees engaged in framing activities were walking the top plate or standing on the trusses, exposing them to an estimated 10-foot fall to the interior wooden deck or an estimated 27-foot fall to the exterior ground. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the Certification of Corrective Action Worksheet), in addition, documentation demonstrating the abatement is complete must be included with your certification.
