29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c): (a)Moss Rock Landscaping, Inc at 916 Eglin Street, Rapid City, SD 57701: On or about and at times prior to October 10, 2024, the exposing employer did not ensure that employees conducting underground water line installation operations within an unprotected excavation greater than five feet in depth were protected from excavation wall cave-in by an adequate protective system. This condition exposed employees to struck-by and cave-in hazards associated with an excavation wall collapse.

29 CFR 1926.651(c)(2): A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that were 4 feet (1.22m) or more in depth so as to require no more than 25 feet (7.62m) of lateral travel for employees: (a)Moss Rock Landscaping, Inc at 916 Eglin Street, Rapid City, SD 57701: On or about and at times prior to October 10, 2024, the exposing employer did not ensure employees that were entering an excavation greater than four feet in depth were provided with a safe means of egress not requiring more than 25 feet of travel. This condition exposed employees to hazards associated with safe egress while working within an unprotected excavation.
