29 CFR 1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets:   a) New residential construction located on Lot 1134 at 149 Night Fire Lane, Dawsonville, GA 30534, Ground level: On or about 10/10/2024, the employer exposed employees to struck-by hazards from upper levels, in that head protection was not provided to ground workers engaged in framing operations at lower levels.

29 CFR  1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m)  or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501(b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502:    a) New residential construction on Lot 1134 at 149 Night Fire Lane, Dawsonville, GA, 30534, Top plate: On or about 10/10/2024, The employer exposed employees to fall hazards of  approximately 21-feet, 8-inches to the lower ground level, in that a fall protection system was not provided to employees engaged in framing activities.

29 CFR 1926.1051(a): Stairway(s) or ladder(s) were not provided at all personnel points of access where there was a break in elevation of 19 inches (48 cm) or more, or no ramp, runway, sloped embankment, or personnel hoist was provided:   a) New residential construction on Lot 1134 at 149 Night Fire Lane, Dawsonville, GA 30534, Top plate: The employer exposed employees to fall hazards up to 10-feet to the lower level, in that the employer did not provide a ladder for access and/or egress to the top plate from the second floor, requiring workers to scale the framework while engaged in framing activities.

29 CFR 1926.102(a)(1): The employer did not ensure employees used eye and face protection equipment when machines or operations presented potential eye or face injury from physical, chemical, or radiation agents:   a) New residential construction on Lot 1134 at 149 Night fire Lane Dawsonville, Georgia, 30534, Jobsite: The employer exposed employees to struck-by hazards while operating pneumatic framing nail guns, in that protective eyewear was not provided to employees using these tools at 140 PSI engaged in framing activities.   Efrain Juarez Guijon was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.102(a)(1), which was contained in OSHA inspection number 1650845, citation number 1, item number 1 and was affirmed as a final order on 7/27/2023, with respect to a workplace located at 1141 Old Salem Rd SE Conyers, GA, 30094.
