OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were not protected from struck-by and caught-in hazards of the moving railcars: On or about October 5, 2024, moving railcars were being cut (separated) on the company's rail line by an employee walking along the tracks to operate the un-coupling handle attached to the railcar. An employee was exposed to the moving railcar's struck-by and caught-in hazards likely to result in serious injuries when present in the danger zone.
