29 CFR  1926.100(a):Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets:  At a worksite located at 3505 Corbin Dr, Lee's Summit, MO, employees were exposed to struck by hazards to their heads.  The employer exposed the employees to these hazards by allowing them to work without the use of head protection while under employees at higher levels.

29 CFR  1926.102(a)(1):  The employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying particles.  At a worksite located at 3505 Corbin Dr, Lee's Summit, MO, employees were exposed to struck by hazards to their eye and face areas.  The employer exposed the employees to these hazards by allowing them to utilize a pneumatic nail gun without the use of eye protection while performing framing activities.

29 CFR  1926.501(b)(13):Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):  At a worksite located at 3505 Corbin Dr, Lee's Summit, MO, employees were exposed to fall hazards.  The employer exposed the employees to these hazards by allowing them to work at heights greater than 6 feet without the use of fall protection while performing framing activities.  Instances of exposure include but are not limited to:  1.  Employee exposed to fall hazards greater than 11 feet while working near the southern eaves of the overhang attached to the western section of the structures roof.   2.  Employee exposed to fall hazards greater than 10 feet while working near the western eaves of the overhang attached to the western section of the structures roof.  3.  Employee exposed to fall hazards greater than 13 feet while working near the northern eaves of the overhang attached to the western section of the structures roof.    Daniel Martinez was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 1541652, citation number 1, item number 1 and was affirmed as a final order on 10/5/2021, with respect to a workplace located at 15841 Reinhardt St, Overland Park, KS.

29 CFR  1926.1053(b)(1):Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:  At a worksite located at 3505 Corbin Dr, Lee's Summit, MO, employees were exposed to fall hazards.  The employer exposed the employee to these hazards by allowing them to utilize a portable extension ladder to access an upper landing surface while the side rails of the ladder did not extend at least 3 feet above the level being accessed.   Daniel Martinez was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.1053(b)(1), which was contained in OSHA inspection number 1541652, citation number 1, item number 3 and was affirmed as a final order on 10/5/2021, with respect to a workplace located at 15841 Reinhardt St, Overland Park, KS.
