Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which is free from recognized hazards which were causing or likely to cause death or serious physical harm to employees in that, employees were exposed to fall, struck-by and caught in-between hazards: (a) On or about October 10, 2024, and at times prior to that date, employees were exposed to fall, struck-by and caught in-between hazards created by riding inside a mine shaft elevator. During operation, the door separated from the car, which allowed an employee to fall out of the door opening and become caught between the mine shaft wall and the elevator car.
