This condition exposed employees to struck-by hazards.

29 CFR 1926.453(b)(2)(v): A body belt was not worn and/or a lanyard was not attached to the boom or basket when working from an aerial lift. Note: As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system. The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated: (a)Maier Construction, LLC at 200 J Avenue, Eureka, SD 57437: On or about and at times prior to October 8, 2024, the employer did not ensure employees were protected from fall hazards in that an employee operated the Genie aerial lift without utilizing a personal fall arrest system. This condition exposed an employee to fall hazards greater than 10 feet.

Or, on roofs 50-feet (15.25 m) or less in width, each employee was not protected by use of a monitoring system: (a)Maier Construction, LLC at 200 J Avenue, Eureka, SD 57437: On or about and at times prior to October 8, 2024, the exposing employer did not ensure employees were protected from fall hazards in that employees performed roofing work without utilizing an appropriate fall protection system, exposed to fall hazards of 13 feet above a lower level.
