29 CFR 1910.212(a)(3)(ii):The point of operation of machines whose operation exposes an employee to injury, shall be guarded. The guarding device shall be in conformity with any appropriate standards therefor, or, in the absence of applicable specific standards, shall be so designed and constructed as to prevent the operator from having any part of his body in the danger zone during the operating cycle. On or about September 26, 2024, the employer did not ensure the point of operation of the Enterprise MFG Alligator Shear, Model No. 250/LH, known to the employer as the "small shear", was guarded to prevent the operator from having any part of his body in the point of operation danger zone during the operating cycle.

29 CFR 1904.39(a)(3):You must report the fatality, in-patient hospitalization, amputation, or loss of an eye using one of the following methods: (i) By telephone or in person to the OSHA Area Office that is nearest to the site of the incident. (ii) By telephone to the OSHA toll-free central telephone number, 1-800-321-OSHA (1-800-321-6742). (iii) By electronic submission using the reporting application located on OSHA's public website at www.osha.gov. On or about October 1, 2024, the employer did not report within 24 hours of being made aware of an in-patient hospitalization injury of a temporary employee who received laceration, fracture, and crushing injuries to his left hand and wrist while operating an alligator shear at the employer's workplace on September 26, 2024. The employer was notified the injury resulted in an in-patient hospitalization on or about September 30, 2024, by the temporary agency. OSHA was not notified of the in-patient hospitalization injury until October 8, 2024, via the OSHA online injury reporting webpage.
