29 CFR  1903.19(d)(1):The employer did not submit to the Agency documents demonstrating that abatement is complete for each willful or repeat violation and for any serious violation for which the Agency indicates in the citation that such abatement documentation is required.  (a)  Daniels Roofing & Framing, LLC failed to document abatement within 10 calendar days after the abatement date that each of the following cited violations had been corrected:  Citation 1, Item 1, a serious violation of 29 CFR 1926.20(b)(2) with an abatement date of March 5, 2025.    Citation 1, Item 3 a serious violation of 29 CFR 1926.503(c)(3) with an abatement date of March 5, 2025.  In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATIONS OF THE CORRECTIVE ACTION WORKSHEET).

29 CFR  1926.20(b)(2): The employer did not initiate and maintain programs which provided for frequent and regular inspections of the job site, materials and equipment to be made by a competent person(s).  (a)  On or about October 16, 2024, the employer did not ensure frequent and regular inspections of the job site were conducted by a competent person to ensure hazardous conditions were identified and corrected.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   (a)  On or about October 16, 2024, employees conducting roofing work on a new residential property with a 7:12 pitch roof, were not protected from falling to the lower level. This exposed employees to a fall hazard of approximately 8 feet over the garage and 18 feet over the residential property.

29 CFR  1926.503(c)(3): 29 CFR 1926.503(c)(3): When inadequacies in an affected employee's knowledge or use of fall protection systems or equipment indicate that the employee has not retained the requisite understanding or skill, the employer shall retrain the affected employee.  (a)  On or about October 16, 2024, the employer did not ensure employees exposed to potential fall hazards had been properly trained to recognize and minimize the fall hazards associated with their work.  This is to include proper installation of anchor points and the proper selection of fall protection equipment.
