OSH ACT of 1970 Section 5(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to combustible particulate solids deflagration, explosion, and fire hazards associated with an indoor spray dryer: (a) Drying Department; On or about October 16, 2024, and dates prior, employees were exposed to combustible particulate solid fire hazards from the operation of the indoor Sterner T-2500-10B-32 co-current bussel style spray dryer, using a 6.5 MMBTU direct-fired main burner to evaporate moisture from food ingredient products. The indoor spray dryer was operated in a manner that presented combustible particulate solid fire hazards in that fuel, oxygen, and an ignition source were capable of being present at the same time within the system. The indoor spray dryer lacked means of fire suppression. (b) Drying Department; On or about October 16, 2024, and dates prior, employees were exposed to combustible particulate solid deflagration and explosion hazards from the operation of the indoor Sterner T-2500-10B-32 co-current bussel style spray dryer, using a 6.5 MMBTU direct-fired main burner to evaporate moisture from food ingredient products. The locks and tags had been in place for approximately two years and were not being used for the purpose of performing lockout/tagout.
