29 CFR 1926.652(d)(2): Manufactured materials and equipment used for protective systems were not used and maintained in a manner that was consistent with the recommendations of the manufacturer: (a) Excavation site located on the shoulder of WI-37, Mondovi; On or about October 16, 2024, only three of the four required spreader bars were installed between the sidewall panels of a 24-foot long x 8-foot high trench shield before it was installed and used to provide cave-in protection in an excavation that ranged in depth from 10-feet, 11-inches to 10-feet, 5-inches.

29 CFR 1904.29(b)(1): The log of occupational injuries and illnesses, (OSHA Form No. 300), was not completed in the detail provided in the form and the instructions contained therein: Gerke Excavating, Inc - 15341 State Highway 131, Tomah. On or about October 16, 2024, the employer did not provide the injury event location (column E), provide a description to identify the object or substance that directly caused the injury (column F), and/or classify the case type (columns G-J) on the OSHA Form 300 or equivalent for calendar year 2024. (a) On or about September 10, 2024, an employee working in Rockport, TX sustained a cut to the top of their left thumb, case no. 8. The object or substance that directly injured the person was not described in column F. (b) On or about August 28, 2024, an employee working at an unidentified location had a callus on their left foot become infected after it was rubbed off, case no. 7. The injury event location was not identified in column E. (c) On or about August 28, 2024, an employee working at an unidentified location had a callus on their left foot become infected after it was rubbed off, case no. 7. The object or substance that directly injured the person was not described in column F. (d) On or about August 28, 2024, an employee working at an unidentified location had a callus on their left foot become infected after it was rubbed off, case no. 7. The injury type was not classified by marking one of the categories in columns G-J. (e) On or about August 7, 2024, an employee working at Hoover Road in Plover, WI sustained a cut to their right thumb, case no. 6. The object or substance that directly injured the person was not described in column F. (f) On or about July 22, 2024, an employee working at Hoover Road in Plover, WI sustained a sprained ankle, case no. 5. The object or substance that directly injured the person was not described in column F.
