29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): a) 513 East Philadelphia Avenue, Boyertown, PA, Roof - On or about October 17, 2024, an employee replacing a residential 8/12 pitch roof was not utilizing acceptable means or methods of fall protection, exposing the employee to a fall hazard of approximately 24 feet to grade. b) 513 East Philadelphia Avenue, Boyertown, PA, Roof - On or about October 17, 2024, employees replacing a residential 2/12 pitch roof were not utilizing acceptable means or methods of fall protection, exposing the employees to a fall hazard of approximately 8 feet to grade. Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic or video evidence of abatement or other written records.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards: a) 513 East Philadelphia Avenue, Boyertown, PA, Roof - On or about October 17, 2024, Employees replaced the roof of a multi-level 2/12 pitch and 8/12 pitch residential structure. Employees were not trained in appropriate fall protection methods to avoid hazards associated with elevated work areas. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and state employees and their representatives were informed of this abatement.

29 CFR 1926.1053(b)(1):Where (a) portable ladder(s) was/were used for access to an upper level landing surface and the ladder's length did not allow the ladder side rails to extend at least 3 feet (0.9 m) above the upper landing surface being accessed, the ladder was not secured at its top to a rigid support that will not deflect, and/or a grasping device was not provided to assist employees in mounting and dismounting the ladder. a) 513 East Philadelphia Avenue, Boyertown, PA, Roof - On or about October 17, 2024, employees accessed the roof using extension ladders to replace a shingle roof on a multilevel single-family house. Employees used ladders not extended at least 3 feet above the upper landing surface. In addition, the ladders were not secured to a rigid support, and there was no grasping device. Employees were exposed to fall hazards more than 20 feet. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and state employees and their representatives were informed of this abatement.
