29 CFR 1910.29(b)(5): The employer did not ensure that guardrails met the requirement that midrails, screens, mesh, intermediate vertical members, solid panels, and other equivalent intermediate members are capable of withstanding, without failure, a force of at least 150 pounds applied in any downward or outward direction at any point along the intermediate member: On or about October 16, 2024, employees engaged in grain operations at 16515 County Road 14, Chappell, Nebraska 69129, were exposed to fall hazards in that the employer did not ensure the mid rail located on the top of the concrete bin was capable of withstanding, without failure, force that accidental contact employees would apply if they were to contact the railing during their limited access to the top of the grain bins.

29 CFR 1910.305(b)(1)(ii): Unused openings in boxes, cabinets, or fittings were not effectively closed: On or about October 16, 2024, employees engaged in grain operations at 16515 County Road 14, Chappell, Nebraska 69129, were exposed to fire and explosion hazards in that the employer did not ensure that all unused openings in electrical conduit fittings were closed to prevent becoming an ignition source to the combustible grain dust produced under normal operations.
