29 CFR 1926.651(j)(2): Employees were not protected from excavated or other materials or equipment that could pose a hazard by falling or rolling into excavations. Protection by placing and keeping such materials or equipment at least 2 feet from the edge of excavations, or by the use of retaining devices that are sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary was not provided: a) 812 Main St, Toms River, NJ - The employer did not ensure that the excavated materials, spoils pile, was kept at least 2 feet from the open trench were the material was excavated from, thus exposing employees to caught-in-between hazards. The material was left piled up at the opening of the trench. This condition was observed on or about October 17, 2024. NOTE: BECAUSE ABATEMENT OF THIS VIOLATION IS ALREADY DOCUMENTED IN THE CASE FILE, THE EMPLOYER NEED NOT SUBMIT CERTIFICATION OR DOCUMENTATION OF ABATEMENT OF THIS VIOLATION AS NORMALLY REQUIRED BY 29 CFR 1903.19.
