29 CFR  1926.1153(c)(1): For each employee engaged in a task identified on Table 1, the employer shall fully and properly implement the engineering controls, work practices, and respiratory protection specified for the task on Table 1, unless the employer assesses and limits the exposure of the employee to respirable crystalline silica in accordance with paragraph (d) of this section.  a) On or about October 18, 2024, the employer did not implement engineering controls and work practices, as specified in Table 1 of 1926.1153 as employees were utilizing a Stihl concrete saw on site to perform demolition on the sidewalk without a water delivery system or a dust collection system exposing employees to airborne respirable crystalline silica.   b) On or about October 18, 2024, the employer did not implement engineering controls and work practices, as specified in Table 1 of 1926.1153 as an employee was drilling into the concrete sidewalk utilizing a handheld drill without a water delivery system or a dust collection system exposing employees to airborne respirable crystalline silica.   c) On or about October 18, 2024, the employer did not implement engineering controls and work practices, as specified in Table 1 of 1926.1153 as an employee was utilizing a jackhammer attachment on a skid steer  without a water delivery system or a dust collection system exposing employees to airborne respirable crystalline silica.

29 CFR  1926.1153(d)(2)(i):  The employer did not assess the exposure of each employee who was or may reasonably be expected to be exposed to respirable crystalline silica at or above the action level in accordance with either the performance option in paragraph (d)(2)(ii) or the scheduled monitoring option in paragraph (d)(2)(iii) of this section:  a) On or about October 18, 2024 the employer did not assess the exposure of the cutting the concrete with the Stihl concrete saw that was utilized by an employee on site to perform demolition on the sidewalk exposing employees to airborne respirable crystalline silica.   b) On or about October 18, 2024 the employer did not assess the exposure of the drilling of the concrete with the handheld drill that was utilized by an employee on site to perform demolition on the sidewalk exposing employees to airborne respirable crystalline silica.   c) On or about October 18, 2024 the employer did not assess the exposure of the jackhammering with the hydraulic rock breaker attached to the skid steer on site that was utilized by an employee on site to perform demolition on the sidewalk exposing employees to airborne respirable crystalline silica.

29 CFR  1926.1153(i)(2)(i): The employer did not ensure that each covered employee could demonstrate knowledge and understanding of at least the information contained in paragraphs (A) - (F) of this section.  On or about October 18, 2024, the employer did not ensure that each employee exposed to silica could demonstrate knowledge and understanding of the health hazards associate with exposure to silica, such as silicosis, lung cancer, chronic obstructive pulmonary disease, immune system effects, and kidney disease.
