29 CFR 1910.147(c)(4)(i): Procedures were not developed, documented and utilized for the control of potentially hazardous energy when employees were engaged in activities covered by this section:  On or about November 14, 2024, and at times prior, at an establishment located at 37721 Stevens Boulevard, Willoughby OH, 44094, lacquer area, mixing vessel #8; employees were exposed to uncontrolled energy while cleaning a mixing blade where procedures were not developed, documented and utilized for the control of potentially hazardous energy.  As a result, hazardous energies including mechanical and electrical were not isolated, exposing employees to caught-in and struck-by hazards associated with the rotating movements of the mixing blades.

29 CFR 1910.147(d): The established procedure for the application of energy control (the lockout or tagout procedures) did not cover the actions listed in and was not done in sequence as required by 29 CFR 1910.147(d)(1)-(6):  On or about November 14, 2024, and at times prior, at an establishment located at 37721 Stevens Boulevard Willoughby OH, 44094, lacquer area; employees were exposed to struck-by hazards while cleaning the mixing blades inside of a mixing vessel. The employer did not ensure that employees implemented energy control application steps or equivalent protective measures prior to allowing them to enter the hazardous area to clean the coating from around the blade.  The machine was not deenergized prior to the employee engaging in the maintenance activity.  As a result, the remaining applicable energy control elements, involving machine isolation [1910.147(d)(3)], lockout/tagout device application [1910.147(d)(4)], dissipation of residual energy [1910(d)(5)(i)], and verification of isolation [1910.147(d)(6)] were not implemented to protect employees from machine maintenance hazards.

29 CFR 1910.147(c)(7)(i): The employer did not provide training to ensure that the purpose and function of the energy control program are understood by employees and that the knowledge and skills required for the safe application, usage, and removal of the energy controls are acquired by employees:  On or about November 14, 2024, and at times prior, at an establishment located at 37721 Stevens Boulevard Willoughby OH, 44094, lacquer area; the employer did not provide training to the employees, as "authorized, affected, and other types" in the controlling of potentially hazardous and unexpected releases of energy sources (lockout/tagout) during servicing and maintenance of equipment on mixing vessel #8.

29 CFR 1910.212(a)(1): One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks:  On or about October 16, 2024, at an establishment located at 37721 Stevens Boulevard Willoughby OH, 44094; the employer did not ensure that effective machine guarding was in place on the F1-10 mixing vessels. Employees were exposed to the rotational movement of the shaft within the base of the mixer. Guarding was not present to prevent employees from reaching into the mixer during operations.
