29 CFR 1926.451(g)(4)(iv): Midrails were not installed at a height approximately midway between the top edge of the guardrail system and the platform surface: Instances including, but not limited to, the following: a) Job site, 7670 McKnight Road, Pittsburgh, PA: On or about October 18, 2024, during masonry work, the employer did not ensure that appropriate fall protection systems/devices were in use along the front of the loading area of the scaffold, exposing an employee to a fall hazard of up to approximately 13 feet, in that only a top rail was in place and no midrail was provided. b) Job site, 7670 McKnight Road, Pittsburgh, PA: On or about October 18, 2024, during masonry work, the employer did not ensure that appropriate fall protection systems/devices were in use at the foot hop area of the scaffold, exposing an employee to a fall hazard of up to approximately 13 feet, in that at the end of the foot hop, only a single outrigger bracket, located approximately 48" above the foot hop platform, was in place and no midrail was provided. c) Job site, 7670 McKnight Road, Pittsburgh, PA: On or about October 18, 2024, during masonry work, the employer did not ensure that appropriate fall protection systems/devices were in use at the ladder entry area, exposing employees to a fall hazard of up to approximately 13 feet, in that only a top rail was in place and no midrail was provided. Harris Masonry, Inc. was previously cited for a violation of this occupational safety and health standard, or its equivalent standard, 29 CFR 1926.451(g)(4)(iv), which was contained in OSHA inspection number 1621503, citation number 1, item number 1, and was affirmed as a final order on March 21, 2023, with respect to a workplace located at White Course Drive, State College, PA.

29 CFR 1926.20(b)(2): A program that provided for frequent and regular inspections of the job sites, materials, and equipment to be made by competent persons was not in use: a) Job site, 7670 McKnight Road, Pittsburgh, PA: On or about October 18, 2024, during masonry work, the employer did not ensure that a system was in place to identify and correct safety hazards. Deficiencies noted during the inspection included, but were not limited to, failing to use appropriate fall protection on scaffolding, working near uncapped rebar, not wearing a seatbelt while operating and forklift and not addressing the hazards associated with deep ground depressions at the work site where employees walked/worked.
