29 CFR 1910.178(l)(1)(ii): The employer did not ensure that each operator had successfully completed the training consisting of a combination of formal instruction (e.g. lecture, discussion, interactive computer learning, video tape, written material), practical training (demonstrations performed by the trainer and practical exercises performed by the trainee), and evaluation of the operator's performance in the workplace. (a) On or about October 18, 2024, the employer did not ensure that all employees that were allowed to operate powered industrial vehicles were trained in the proper use of forklifts and evaluated in their ability to use a powered industrial vehicle. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement or other written records.
