29 CFR  1910.134(c)(2)(ii): The employer did not establish and implement those elements of a written program necessary to ensure that any employee using a respirator voluntarily was medically able to use that respirator, and that the respirator was cleaned, stored, and maintained so that its use does not present a health hazard to the user:   a) Area behind the maintenance shop and in the dry bulk trailers. On 21 Oct 2024 and at times prior to, the employer provided half face elastomeric respirators to employees for voluntary use when using aluminum cleaner and brightener to clean trucks and when entering the dry bulk trailers for the purpose of cleaning the concrete residue from the interior and had not established and implemented the elements of a written respiratory protection program, employee training and medical evaluation in accordance with the standard.

29 CFR  1910.1200(e)(1): Employer had not developed or implemented a written hazard communication program that included the requirements outlined in 29 CFR 1910.1200(e)(1)(i) and (e)(1)(ii):    a) The maintenance shop and surrounding area, On or about October 21, 2024, and at times prior to the employer required employees to use hazardous chemicals, such as but not limited to  aluminum cleaner and brightener, without developing an effective written hazard communication program as required by the standard.
