29 CFR  1926.102(a)(1): The employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying particles.  On or about October 21, 2021, employees engaged in residential construction activities were exposed to struck-by hazards while utilizing a pneumatic nail gun while installing shingles without proper eye or face protection.

29 CFR  1926.501(b)(1): Each employee on a walking/working surface having an unprotected side or edge which was six or more feet (1.8m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.  On or about October 21, 2024, on the northside of the construction site, employees engaged in residential construction activities were exposed to fall hazards while installing roof shingles from heights above 6 feet without fall protection.   Next Gen Roofing was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR  1926.501(b)(1), which was contained in OSHA inspection number 1744540, citation number 1, item number 1 and was affirmed as a final order on September 17, 2024, with respect to a workplace located at 2077 Zaragoza Rd., El Paso, TX 79938.

29 CFR  1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:   On or about October 21, 2024, employees engaged in residential construction activities (installing shingles) were exposed to fall hazards in excess of 6-feet while using ladders that did not extend at least 3-feet above the roof's landing in the following instances:  a) First story rear porch landing.  b) Second story from the porch landing to roof top.

29 CFR  1926.1053(b)(5)(i): Non-self-supporting ladders were not used at an angle such that the horizontal distance from the top support to the foot of the ladder was approximately one-quarter of the working length of the ladder (the distance along the ladder between the foot and the top support).  On or about October 21, 2024, on the northside of the construction site, employees were exposed to fall hazards when an extension ladder was not set at the proper angle (4:1 ratio) when leaned against the roof edge.
