29 CFR 1910.147(d):  The established procedure for the application of energy control (the lockout or tagout procedures) did not cover the actions listed in and was not done in sequence as required by 29 CFR 1910.147(d)(1)-(6):  On or about October 14, 2024, at an establishment located at 205 West Cedar Street in Spencer, Wisconsin; employees were exposed to machine hazards associated with moving parts when they engaged in cleaning activities on The Gold Standard Powermatic Table Saw.  The employer did not ensure that employees implemented energy control application steps or equivalent protective measures prior to allowing them to remove scrap wood under the guard.  The machine was not deenergized prior to the employee engaging in the servicing / maintenance activity.  As a result, the remaining applicable energy control elements, involving machine isolation [1910.147(d)(3)], lockout/tagout device application [1910.147(d)(4)], dissipation of residual energy [1910(d)(5)(i)], and verification of isolation [1910.147(d)(6)] were not implemented to protect employees from machine hazards.

29 CFR 1910.178(a)(4):  Modifications and additions which affect capacity and safe operation shall not be performed by the customer or user without manufacturers prior written approval. Capacity, operation, and maintenance instruction plates, tags, or decals shall be changed accordingly.  On or about October 21, 2024, at an establishment located at 205 West Cedar Street in Spencer, Wisconsin;   (a)  The employer attached 6-foot fork extensions on the Caterpillar Propane Forklift, Model: GC25, S/N: 4EM90604, to move longer pallets of product without prior written approval by the manufacturer of the forklift and did not update the capacity and operation plates.  (b)  The employer attached 6-foot fork extensions on the Green Mitsubishi Propane Forklift, Model: GF25N, S/N: AF17E00897, to move longer pallets of product without prior written approval by the manufacturer of the forklift and did not update the capacity and operation plates.

29 CFR 1910.178(q)(7): Industrial trucks shall be examined before being placed in service and shall not be placed in service if the examination shows any condition adversely affecting the safety of the vehicle. Such examination shall be made at least daily. Where industrial trucks are used on a round-the-clock basis, they shall be examined after each shift. Defects when found shall be immediately reported and corrected.  On or about October 21, 2024, at an establishment located at 205 West Cedar Street in Spencer, Wisconsin; the employer did not ensure the industrial trucks, Caterpillar Propane Forklift, Mitsubishi Propane Forklift, and Mitsubishi propane forklift, were examined, at least daily, prior to being placed into service exposing employees to struck-by hazards associated with potentially faulty powered industrial truck components.

29 CFR 1910.178(n)(7)(iii):  On all grades the load and load engaging means shall be tilted back if applicable and raised only as far as necessary to clear the road surface.  On or about October 21, 2024, at an establishment located at 205 West Cedar Street in Spencer, Wisconsin; an employee operating a Mitsubishi propane forklift, Model FG25N, S/N:  AF17E00904, with a load had the forks raised to approximately hip height while traveling in reverse and forward.  The elevated forks exposed employees to struck by hazards.

29 CFR 1910.213(c)(1):  Each circular hand-fed ripsaw shall be guarded by a hood which shall completely enclose that portion of the saw above the table and that portion of the saw above the material being cut. The hood and mounting shall be arranged so that the hood will automatically adjust itself to the thickness of and remain in contact with the material being cut but it shall not offer any considerable resistance to insertion of material to saw or to passage of the material being sawed. The hood shall be made of adequate strength to resist blows and strains incidental to reasonable operation, adjusting, and handling, and shall be so designed as to protect the operator from flying splinters and broken saw teeth. It shall be made of material that is soft enough so that it will be unlikely to cause tooth breakage. The hood shall be so mounted as to insure that its operation will be positive, reliable, and in true alignment with the saw; and the mounting shall be adequate in strength to resist any reasonable side thrust or other force tending to throw it out of line.  On or about October 21, 2024 and thereafter, at an establishment located at 205 West Cedar Street in Spencer, Wisconsin; the Gold Standard Powermatic Table Saw used for cutting and ripping wood had an adjustable guard that was broken on the left side, exposing employees to amputation and laceration hazards.

29 CFR 1910.213(c)(3):  Each hand-fed circular ripsaw shall be provided with non-kickback fingers or dogs so located as to oppose the thrust or tendency of the saw to pick up the material or to throw it back toward the operator. They shall be designed to provide adequate holding power for all the thicknesses of materials being cut.  On or about October 14, 2024 and thereafter, at an establishment located at 205 West Cedar Street in Spencer, Wisconsin; the Gold Standard Powermatic Table Saw used for ripping and cutting wood had the non-kickback fingers in the locked elevated position, exposing employees to struck-by hazards.
