29 CFR 1926.651(j)(2): Protection was not provided by placing and keeping excavated or other materials or equipment at least 2 feet (0.61 m) from the edge of excavations, by using retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary.  On or about October 21, 2024, and at times prior to that date, on the north side near 915 E 33rd St. in Edmond, Oklahoma, employees were performing pipeline installation work activities in an excavation without ensuring that spoil piles were located more than two (2) feet from the wall of the excavation.  B & H Construction LLC was previously cited for a violation of this occupational safety and health standard or its equivalent, 29 CFR 1926.651(j)(2), which was contained in OSHA inspection number 1519070, citation number 2, item number 1, and was affirmed as a final order on July 16, 2021, regarding a workplace located at 2700 Telephone Rd, Moore, OK 73170.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(b) or (c).  On or about October 21, 2024, and at times prior to that date, near 915 E 33rd St. in Edmond, Oklahoma, protective systems were not in place to protect employees working in an excavation that was more than 5 feet deep, exposing the employees to the hazard of being crushed by falling soil.  B & H Construction LLC was previously cited for a violation of this occupational safety and health standard or its equivalent, 29 CFR 1926.652(a)(1), which was contained in OSHA inspection number 1518853, citation number 1, item number 1a, and was affirmed as a final order on June 21, 2021, regarding a workplace located at 1303 W Tecumseh Rd, Norman, OK 73069.  B & H Construction LLC was also previously cited for a violation of this occupational safety and health standard or its equivalent, 29 CFR 1926.652(a)(1), which was contained in OSHA inspection number 1462585, citation number 1, item number 1a, and was affirmed as a final order on April 23, 2020, regarding a workplace located at 7th and Cemetery Road, Yukon, OK 73099.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed.  On or about October 21, 2024, and at times prior to that date, near 915 E 33rd St. in Edmond, Oklahoma, employees performing pipeline installation work activities in an excavation utilized a portable extension ladder for access/egress where the side rails did not extend at least three (3) feet above the edge of the excavation.  The B & H Construction LLC. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.1053(b)(1), which was contained in OSHA inspection number 1519070, citation number 2, item number 2 and was affirmed as a final order on July 16, 2021, with respect to a workplace located at 2700 telephone Rd. Moore, Ok,73170.
