29 CFR 1928.57(a)(7)(i): The employer did not protect employees from coming into contact with hazards created by moving machinery parts through the installation and use of a guard or shield or guarding by location: a) Hemdale Farms Inc, at the Lawnhurst Farms Site - Field # LH-18, Stanley, NY. On or about September 20, 2024, employees accessed and exited the tractor for the 2-Row Mounted Cabbage Harvester while exposed to unguarded moving machinery parts. The employer did not ensure the knife blade near the back wheel was guarded to protect employees from amputation hazards.

1928.57(a)(6)(iii) Engine was not stopped, power source not disconnected, and machine movement did not cease before servicing, adjusting, cleaning, or unclogging the equipment occurred, except where the machine must be running to be properly serviced or maintained, in which case the employer shall instruct employees as to all steps and procedures which are necessary to safely service or maintain the equipment; a) Hemdale Farms Inc, at the Lawnhurst Farms Site - Field # LH-18, Stanley, NY. On or about September 20, 2024, employees were permitted to dislodge rocks and cabbage from the 2-Row Mounted Cabbage Harvester without first ensuring all power sources were rendered inoperable resulting in an amputation. The employer did not ensure employees stopped the engine, disconnected all power sources, and waited for all machine movement to stop before servicing, adjusting, cleaning, or unclogging the equipment.
