29 CFR 1910.147(d): General Environmental Controls. Application of control. The established procedure for the application of energy control (the lockout or tagout procedures) did not cover the actions listed in and was not done in sequence as required by 29 CFR 1910.147(d)(1)-(6). On or about October 15, 2024, at N9090 Co Hwy E in Tomahawk, Wisconsin, employees were exposed to struck-by hazards while cleaning the work surface at the feed-side of a moving 3-foot-high recycling conveyor with double stacked cardboard bales. The employer did not ensure that employees implemented energy control application steps or equivalent protective measures prior to allowing them to enter the hazardous area to clean the cardboard from around the machine. The machine was not deenergized prior to the employee engaging in the maintenance activity. As a result, the remaining applicable energy control elements, involving machine isolation [1910.147(d)(3)], lockout/tagout device application [1910.147(d)(4)], dissipation of residual energy [1910(d)(5)(i)], and verification of isolation [1910.147(d)(6)] were not implemented to protect employees from machine maintenance hazards.

29 CFR 1910.178(l)(3)(ii)(I): Workplace-related topics. Powered industrial truck operators shall receive initial training in other unique or potentially hazardous environmental conditions in the workplace that could affect safe operation. On or about October 15, 2024, at N9090 Co Hwy E in Tomahawk, Wisconsin, the employer did not ensure the company's forklift operator safety training program had included the exposure to struck-by hazards for operators working at the feed side of the Hydrapulper recycling conveyor. Employees double stacked cardboard bales on conveyor and cleaned the area as needed, working in the fall shadow of the bales.
