29 CFR 1926.453(b)(2)(v):A body belt was not worn and/or a lanyard was not attached to the boom or basket when working from an aerial lift:Note: As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system. The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated. At a commercial worksite located at 19000 E Truman, Independence, Missouri. An employee was exposed to a fall hazard as he performed work tasks from the basket of a Terex Telelect NT29 telescopic bucket truck, without using a body belt or wearing a harness, resulting in being ejected from bucket truck at a height of approximately 15 feet to the concrete surface below.

29 CFR 1926.453(b)(2)(viii):29 CFR 1926.453(b)(2)(viii): An aerial lift truck was moved when the boom was elevated in a working position with men in the basket and was not specifically designed for this type of operation in accordance with the provisions of paragraphs (a)(1) and (2) of this section. At a commercial worksite located at 19000 E Truman, Independence, Missouri. An employee was exposed to a fall hazard as he performed work tasks from the basket of a Terex Telelect NT29 telescopic bucket truck, the bucket was elevated and being driven against manufacturers recommendations per warning stickers affixed to the bucket.
