29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace (Construction Reference: 1926.103):  (a) East underground gasoline storage tank; On or about October 23, 2024, an employee required to wear a half-facepiece elastomeric respirator while working within an underground tank to vacuum/clean residual fuel from the tank, was not provided with an evaluation to ensure that the employee was medically able to use the respirator.

29 CFR 1910.134(f)(1): The employer did not ensure that employee(s) required to use a tight-fitting facepiece respirator passed the appropriate qualitative fit test (QLFT) or quantitative fit test (QNFT) (Construction Reference: 1926.103):   (a) East underground gasoline storage tank; On or about October 23, 2024, an employee required to wear a half-facepiece elastomeric respirator while working within an underground tank to vacuum/clean residual fuel from the tank, was not fit-tested to ensure effective protection was provided against potential respiratory hazards, including but not limited to, organic vapors.

29 CFR 1926.1203(e)(2)(ii): When entrance covers were removed the opening was not immediately guarded by a railing, temporary cover, or other temporary barrier that would prevent an accidental fall through the opening and that would protect each employee working in the space from foreign objects entering the space:  (a) Underground gasoline storage tanks; On or about October 23, 2024, after inspection and/or access openings roughly 2-feet to 2.5-feet in diameter were cut into the tops of exposed underground fuel storage tanks, classified as permit spaces, temporary railings, covers, or other barriers were not installed to protect employee(s) working near the openings from falling approximately 8-feet to the tank bottoms, and/or, to protect an employee working within a tank from foreign objects falling into the space.

29 CFR 1926.1211(c)(2): The other end of the retrieval line was not attached to a mechanical device or fixed point outside the permit space as required and/or a mechanical device was not available to retrieve personnel from vertical type permit spaces more than 5 feet (1.52 meters) deep:  (a) East underground gasoline storage tank; On or about October 23, 2024, an employee who was working within an underground tank, classified as a permit space with an approximate vertical entry depth of 8-feet, to vacuum/clean residual fuel from the tank, was wearing a full body harness with a retrieval line that was not attached at the other end to a mechanical device or fixed point and a mechanical retrieval system was not available.
