29 CFR  1910.1200(e)(1):The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met:   a) On or about October 11th, 2024 the employer Sealtek Asphalt Sealing Corp did not develop and implement the elements of a written hazard control program for employees exposed to hazardous chemicals such as but not limited to unleaded gasoline when refueling the Kohler Command Pro generator. Employees are exposed to contact hazards which could result in health effects such as skin irritations and/or burns.

29 CFR  1910.1200(h)(1): The employer did not provide employees with effective information and training on hazardous chemicals in their work area at the time of their initial assignment, and whenever a new chemical hazard the employees have not previously been trained about is introduced into their work area. Information and training may be designed to cover categories of hazards (e.g., flammability, carcinogenicity) or specific chemicals. Chemical-specific information must always be available through labels and safety data sheets.  a) On or about October 11th, 2024 the employer Sealtek Asphalt Sealing Corp did not provide employees with effective information and training on hazardous chemicals in their work area, as employees were tasked with handling hazardous chemicals, such as but not limited to handling unleaded gasoline when refueling the Kohler Command Pro generator were exposed to contact hazards such as skin irritations and/or burns.

By receiving no form of training for this task employees were exposed to burn hazards associated with fire.

29 CFR  1926.152(a)(1):  Approved safety cans or Department of Transportation approved containers were not used for the handling and use of flammable liquids in quantities of 5 gallons or less, except that this shall not apply to those flammable liquid materials which are highly viscid (extremely hard to pour), which may be used and handled in original shipping containers. For quantities of one gallon or less, the original container may be used, for storage, use and handling of flammable liquids.  a)  On or about October 11th, 2024 near the address of 145 Dallas St Tiffin, Ohio the employer Sealtek Asphalt Sealing Corp did not ensure that employees tasked with refueling the Kohler Command Pro generator were using a safety can with an approved self-closing valve in that employees were utilizing the Scepter FR1G501 Gas Can that was a squeeze-controlled flow rate, exposing them to fire hazards.

29 CFR  1904.39(a)(2):The employer did not report within 24-hours a work-related incident resulting in in-patient hospitalization, amputation or the loss of an eye.  a) On or about October 11th, 2024 at Sealtek Asphalt Sealing Corp a work related incident resulting in an in-patient hospitalization occurred due to a burn accident on a jobsite that was reported to the Toledo Area OSHA Office on October 21st, 2024, which was outside the mandated 24-hour reporting time frame.
