29 CFR  1910.28(b)(3)(iv): The employer did not ensure each employee was protected from falling into a ladderway floor hole or ladderway platform hole by a guardrail system and toeboards erected on all exposed sides, except at the entrance to the hole, where a self-closing gate or an offset must be used.  a) Terphane LLC,  2754 West Park Drive, Bloomfield, New York, 14469, Extrusion Room.    On or about October 18, 2024, an employee was exposed to a fall height of approximately 12 feet and 7-inches when the top of the fixed ladderway used to access the mezzanine did not protect the employee from falling onto a lower level.  The ladderway did not have a self-closing gate and/or offset.

29 CFR  1910.134(c)(2)(i): Respirator users were not provided with the information contained in Appendix D to 29 CFR 1910.134 when the employer determined that any voluntary respirator use was permissible:  a) Terphane LLC,  2754 West Park Drive, Bloomfield, New York, 14469, Trans-Directional Operation Area Control Table.   The employer did not provide an employee with the information contained in Appendix D of the Respiratory Protection Standard ("Information for Employees Using Respirators When Not Required Under the Standard"), when the employer permitted an employee to use a 3M Model 8210V, N95 Filtering Face Piece Respirator.
