29 CFR 1910.132(d)(2): The employer did not verify, through a written certification, that the required workplace hazard assessment had been performed: a) Maintenance Shop - On or about October 24, 2024, the employer did not certify that a workplace hazard assessment had been performed for employees operating the Le Blond Lathe machine. Employees were exposed to hazards that required the use of personal protective equipment including, but not limited to, eye protection and hand protection.

29 CFR 1910.138(b): The employer did not base selection of appropriate hand protection on an evaluation of the performance characteristics of the hand protection relative to the tasks to be performed, conditions present, duration of use, and the hazards and potential hazards identified: a) Maintenance Shop - On or about October 2024, an employee was sanding a steel rod that was attached to a moving Le Blond Lathe machine. The employee was wearing gloves and when the gloves got caught and wrapped the employees right middle, ring and pinky fingers around the steel rod causing compound fractures. The employer did not perform a PPE Hazard Assessment for the job being conducted which would have addressed the use or need for appropriate hand protection. This caused the employee to be exposed to hazards associated with rotating parts.

29 CFR 1910.212(a)(1): One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks: a) Maintenance Shop - On or about October 24, 2024, the employer failed to provide effective guarding to protect employees working at or near the Le Blond Lathe machine rotating chuck. Thereby exposing employees to rotating parts and caught-by hazards while operating the Blond Lathe machine.
