29 CFR 1910.1200(e)(1): The employer did not develop, implement and maintain at the workplace, a written hazard communication program which at least describes how the criteria specified in paragraphs (f), (g) and (h) of this section for labels and other forms of warning, material safety data sheets, and employee information and training will be met, and had not developed or implemented a written hazard communication program which at included the requirements outlined in 29 CFR 1910.1200(e)(1)(i) and (e)(1)(ii): a.) 1370 Arcadia Road, Lancaster, PA - Company Wide - Employees were using chemicals including, but not limited to, electronic circuit board/component cleaners and solders. The employer did not develop, implement, or maintain a workplace written hazard communication program, on or about October 28, 2024. b.) 1370 Arcadia Road, Lancaster, PA - Company Wide - Employees were using chemicals including, but not limited to, electronic circuit board/component cleaners and solders. The employer did not compile a list of the hazardous chemicals known to be present using a product identifier that was referenced on the appropriate safety data sheet(s), on or about October 28, 2024. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

29 CFR 1910.1200(f)(6)(ii): The employer did not ensure that each container of hazardous chemicals in the workplace was labeled, tagged or marked with the product identifier and words, pictures, symbols, or combination thereof, which provide at least general information regarding the hazards of the chemicals and which, in conjunction with the other information immediately available to employees under the hazard communication program, would provide employees with the specific information regarding the physical and health hazards of the hazardous chemical: a.) 1370 Arcadia Road, Lancaster, PA - Company Wide - On or about October 28, 2024, the employer did not ensure that chemicals stored in secondary use containers (i.e. spray bottles) were properly labeled, marked or tagged with the product identifier and words, pictures, symbols, or combination thereof in order to provide general information regarding the chemical to the employee(s).
