29 CFR 1910.156(b)(1): Organizational statement. The employer shall prepare and maintain a statement or written policy which establishes the existence of a fire brigade; the basic organizational structure; the type, amount, and frequency of training to be provided to fire brigade members; the expected number of members in the fire brigade; and the functions that the fire brigade is to perform at the workplace. The organizational statement shall be available for inspection by the Assistant Secretary and by employees or their designated representatives. On or about October 19, 2024, at an establishment located at 190 Third Street, Menasha, Wisconsin; at Paper Machine 2, the employer failed to prepare and maintain a statement or policy that established the existence of a fire brigade; the basic organizational structure; the type, amount, and frequency of training to be provided to fire brigade members; the expected number of members in the fire brigade; and the functions that the fire brigade is to perform at the workplace, exposing employees to hazards associated to fires such as thermal burns and smoke inhalation.

29 CFR 1910.156(c)(1): The employer shall provide training and education for all fire brigade members commensurate with those duties and functions that fire brigade members are expected to perform. Such training and education shall be provided to fire brigade members before they perform fire brigade emergency activities. Fire brigade leaders and training instructors shall be provided with training and education which is more comprehensive than that provided to the general membership of the fire brigade. On or about October 19, 2024, at an establishment located at 190 Third Street, Menasha, Wisconsin; at Paper Machine 2, de facto fire brigade members responding to paper fires were exposed to hazardous by-products of a fire (smoke, toxic gases, heated air) and burns from flame, in that they did not receive specific training for the emergency operations in which they were to participate, training on their specific roles or duties, or training on the use of personal protective equipment that may be required.

29 CFR 1910.261(b)(1): Lockouts. Devices such as padlocks shall be provided for locking out the source of power at the main disconnect switch. Before any maintenance, inspection, cleaning, adjusting, or servicing of equipment (electrical, mechanical, or other) that requires entrance into or close contact with the machinery or equipment, the main power disconnect switch or valve, or both, controlling its source of power or flow of material, shall be locked out or blocked off with padlock, blank flange, or similar device. On or about October 22, 2024, at an establishment located at 190 Third Street, Menasha, Wisconsin; while performing maintenance activities, the DAF Skimmer for Paper Machine 4 was not de-energized prior to making an adjustment on the oil leveler needle exposing employee(s) to struck by hazards.
